Like what I posted before, this evidence was obtained during an illegal search (reading of private property) and according to the Exclusionary clause of the 4th amendment cannot be used to incriminate.

At some point, Ex will have an expulsion hearing. In order for an expulsion to proceed they will have to prove that there is a reason for it.

And evidence obtained illegally cannot be used in a proof.

Ex, in your Indiana law brief there, it mentions not passing any object that may be a knife or used as a weapon. If you do get a hearing, may want to ask what the definition of "What may be used as a weapon". If I pass someone a pencil, can they not use it for murder? How about a peice of paper? A pen? A textbook? A notepad? They can all be used for murdererous purposes and thus can all be defined as weapons. Okay that was just my little rant, but now on to my main thing...

Your school is a little strict (and coming from my school this is saying something). We have very strict rules, yet they don't enforce them very much. Think, you supposedly write a hit list and get in trouble, and someone I know throws a $500 CPR Dummy out the Health Class Window (second story window) and doesn't even get put in ISS.

As for illegal search and seizure before the expulsion committee as evidence, doubt they'll pay much attention to the evidence being obtained illegaly. This is the United States of America, where the most corrupt person wins!

(This is the part where I like to have all the dirt on everyone! Yes, I don't get picked on at school, I know too much!)

Update.

I got the journal back today. She found nothing in it. and everything about the hit list was dropped. no damage or marks were made in the journal. so thats a good thing.

but the bad thing is i cant take it to school again with out it being confiscated for the rest of the year.

yeah, that's good to hear. but it was madness for them to think it was a hitlist in the first place. i guess that teacher must've really been one hell of a bitch. ;)

and DAMN ex. you're school is strict as hell. you go to a private school or something? in my high school we can eat/drink/chew gum in the middle of class. i'm usually done with half my lunch by 4th period (5th period lunch) and cell phones/'gameboys'/pretty much any electronic device is allowed. you can't use it in the middle of class but they're all allowed. hell, my friend brings a freakin laptop into school everyday. lol.

AT my school, you can't:

Even be in the possesion of gum, electronics of ANY KIND (Cell phones, PDAs, anything), or a weapon (You say "duh", but read on.)

What they consider weapons:

Nail Files, Nail Clippers, Scissors (yes, I said scissors. You have to get them from a teacher.), Compasses (the math tool), anything with any kind of point, anything that explodes, including model rockets and the like, and, of course, guns.

Should I even try to go over the dress code? ;)

Sometimes, I feel like sending an e-mail to the principle with a pic like this attached:
