Err, I believe it is legal.

If the ESA or whatever has a problem with the game being uploaded, then the site takes it down voluntarily.

It is not piracy, otherwise the underdogs website would have been shutdown many years ago.

Some games on Abandonia are still esa protocted but it is shown that it is still protected, like for example, Warcraft or Command and Conquer. As a result, you cannot download these games.

That's not true.  It's not legally distributable unless the distributer has released it for free download, or has given permission for it to be done so.  The reason Home of the Underdogs isn't shut down (which it almost was a few times) is because if any company or group (i.e. the former IDSA) protests their game being on the site, it's taken down.
